Frequently asked questions
Does the AI Act apply to a company that only uses ChatGPT or Copilot?
Yes, but for most everyday uses (writing, summaries, translation) with few duties: AI literacy of staff and, when dealing with customers, transparency. The company is a “deployer”. Stricter rules only apply when AI is used to decide about people or in other high-risk uses.
When do high-risk obligations apply?
After the Digital Omnibus (Regulation (EU) 2026/1744): from 2 December 2027 for stand-alone Annex III systems (employment, credit, education, critical infrastructure …) and from 2 August 2028 for AI in regulated products under Annex I.
What already applies?
Prohibited practices and AI literacy since 2 February 2025, rules for general-purpose models since 2 August 2025, transparency duties (chatbots, labelling deepfakes) since 2 August 2026. Supervision of AI literacy applies from 3 August 2026.
Is using AI in recruitment prohibited?
No, but it is high-risk: screening, filtering and ranking applications and deciding on promotion or dismissal. Recognising the emotions of employees and candidates at work is prohibited (except for medical or safety reasons).
Who enforces the AI Act in Slovenia?
Under ZIUDHPUI (Official Gazette 85/2025) five market surveillance authorities — AKOS, the Information Commissioner, the Bank of Slovenia, the Insurance Supervision Agency and the Market Inspectorate; AKOS is the single point of contact.
